We współczesnym świecie stalking, cyberstalking oraz mowa nienawiści uważane są za zachowania stanowiące poważne naruszenie praw człowieka w tym  prawa do wolności, prywatności i godności osobistej. Zwłaszcza przestępstwa z nienawiści (hate crimes) są poważnym problemem dla rozwoju społeczeństwa. Otocznie społeczne nie może tolerować zachowań nacechowanych dręczeniem ofiar,  ich prześladowaniem w internecie lub świecie realnym. Nie możemy być obojętni na  propagowanie nienawiści rasowej, etnicznej, wyznaniowej i ogólne szerzenie nietolerancji wobec drugiego człowieka podważającej ideę demokracji, bezpieczeństwa i pluralizmu. Także organy ścigania nie mogą pozostawać bierne w odniesieniu do takich czynów zabronionych jak: przemoc i gorżba bezprawna motywowane uprzedzeniami (art. 119 K.k.),  stalking (art. 190 a K.k.), propagowanie faszyzmu i totalitaryzmu ( art. 256 K.k.), rasizm (art. 257 k.k.),  obraza uczuć religijnych (art. 196 K.k.), zniesławienie (art. 212 K.k.) oraz  zniewaga (art. 216 K.k.), choć wiele zależy od postawy samych osób pokrzywdzonych.  W artykule przedstawiono problematykę stalkingu i cyberstalkingu oraz przestępstw wynikających z mowy nienawiści i dokonano próby oceny przjętych regulacji prawnych penalizujących te zachowania.

 

 

Criminalization phenomena of stalking, cyberstalking and hate speech - an attempt to assess the adopted legal solutions at the level of criminal law


The article presents the problem of stalking and cyberstalking and offenses arising from hate speech and attempted evaluation of the acquired legislation criminalizing these phenomena. In the modern world stalking, cyberstalking, and hate speech are considered behaviors thaat constitute a serious violation of human rights including the right to liberty, privacy and dignity. Especially hate crime (hate crimes) are a serious problem for the development of society. Feeling of indulgence society can not tolerate behavior marked by tormented victims, their persecution on the Internet or the real world. We can not be indifferent to the promotion of racial, ethnic, religious hatred.  General spread of intolerance towards other people undermines the idea of democracy, security and pluralism. Also, law enforcement agencies can not remain passive in relation to such offenses as violence and threat unlawfuly motivated by prejudice (art. 119 of the Penal Code), stalking (art. 190 a of the Penal Code), promotion of fascism and totalitarianism (art. 256 of the Penal Code), racism ( art. 257 of the Penal Code), insult of religious feelings (art. 196 of the Penal Code), defamation (art. 212 of the Penal Code) and insult (art. 216 of the Penal Code), although much depends on the attitudes of victims.
